These Terms of Use are an agreement between you and Bushwick & Devoe LLC (“Theater,” “we,” “us”). By creating an account or using gettheater.app or the Theater application, you agree to these terms and to our Privacy Policy. You must be at least 18 years old and able to form a binding contract to use Theater. If you use Theater on behalf of an organization, you represent that you are authorized to bind that organization.
Theater is a personal operating system for organizing and executing your work, with an AI assistant called Maistro. Theater is currently offered in private beta. Features may change, break, or be removed, and the service is provided on an early-access basis. We may modify or discontinue any part of the service at any time. If we discontinue the service, we will give reasonable notice where practicable and a way to export your content.
You are responsible for the activity under your account and for keeping your login credentials secure. Tell us promptly at hello@gettheater.app if you believe your account has been compromised. You are responsible for the accuracy of the information you provide.
You own the content you create, upload, or import (“Your Content”), and we claim no ownership of it.
To operate Theater for you, you grant Bushwick & Devoe LLC a limited, non-exclusive, worldwide, royalty-free license to host, store, back up, cache, reproduce, process, transmit, and display Your Content, and to sublicense these rights to our service providers (such as hosting, database, email, and AI providers) solely to the extent needed for them to perform services for us. This license exists only to (a) provide, secure, maintain, and operate the service for you; (b) send the parts of Your Content necessary to our AI provider to generate the outputs you request; and (c) display and make Your Content available to the collaborators you choose to invite, in the roles you assign them.
This license ends when you delete Your Content or your account, except that residual copies may persist in routine backups and caches for a limited period before being overwritten, which is no longer than 30 days, and we may retain copies where required by law or to resolve disputes. Content you have shared with collaborators may remain visible to them until they, or you, remove it.
Your work is yours, and we never sell it or use it to train shared or foundation AI models. Maistro personalizes to you using your own data, so the value of your work stays with you, as described in the Privacy Policy.
You agree not to:
Theater lets you add and import contacts, including from LinkedIn or phone-contact files. When you provide information about other people, you represent and warrant that you have a lawful basis and any consent or notice required by law to share that information with us and to have us process it for the features you use. You are responsible for that data as between you and Theater. We handle imported contact data as described in the Privacy Policy, including a deletion path for people who are not Theater users.
Maistro and other AI features generate outputs (drafts, summaries, suggestions, coaching) using third-party AI models. AI outputs can be wrong, incomplete, biased, out of date, or entirely fabricated, including inventing facts, names, numbers, dates, quotes, or citations that look plausible but are false. You are responsible for reviewing every AI output before you rely on it, act on it, or send it to anyone, and for independently verifying any factual, financial, legal, or personal information in it. Maistro proposes; you approve; nothing is sent or acted on without your confirmation.
You can invite others to collaborate on a production with a role (such as Co-Director, Cast, or Audience). You are responsible for who you invite and what you share with them. Collaborators can see and, depending on their role, act on the shared production. You can remove access at any time. Content shared into a production others own or co-own may remain with that production after you leave, as described in the Privacy Policy.
If you send us suggestions, ideas, or feedback, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use them for any purpose, without obligation or compensation to you. This does not change our commitments about Your Content in Section 4 or the Privacy Policy.
Theater is free to use during the private beta. We expect to offer paid subscription plans in the future. If we introduce fees, we will present the pricing and terms before you are charged, and your continued use of a paid plan will be subject to those terms.
Theater, including the software, design, and the Theater and GetTheater names and marks, is owned by us and protected by intellectual-property laws. These terms do not grant you any right to our marks or software except the limited right to use the service. Your Content remains yours as described in Section 4.
Theater works with third-party services, such as Google Calendar and our infrastructure providers. Your use of those services is governed by their own terms, and we are not responsible for them. Connecting or using a third-party service is your choice.
We respond to notices of alleged copyright infringement. Send notices with the information required by the DMCA (17 U.S.C. §512) to hello@gettheater.app. We may remove content and terminate repeat infringers.
You can stop using Theater and delete your account at any time. We may suspend or terminate your access if you violate these terms, if required by law, or if we discontinue the service. On termination, the licenses you granted us end, and we handle your data as described in the Privacy Policy. Sections that by their nature should survive termination (such as ownership, disclaimers, limitation of liability, and indemnification) will survive.
To the extent permitted by law, you will indemnify and hold harmless Bushwick & Devoe LLC and its officers and agents from and against any third-party claims, damages, liabilities, and reasonable costs (including reasonable attorneys’ fees) arising out of or relating to: (a) Your Content; (b) contacts or other third-party information you import, upload, or share, including any claim that you lacked the right to provide it or that its use violated another person’s rights; (c) your violation of these terms or of applicable law; or (d) your misuse of the service. We will notify you of any such claim, and you may not settle a claim in a way that imposes obligations on us without our consent. This section does not require you to indemnify us for liability arising from our own gross negligence, willful misconduct, or violation of law.
These terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules. Any dispute arising out of these terms or your use of Theater will be brought in the state or federal courts located in New York County, New York, and you and we each consent to the jurisdiction of those courts. There is no mandatory arbitration clause here, and nothing in these terms stops you from bringing a claim in small claims court or raising a complaint with a consumer protection authority where you live.
We may update these terms as Theater grows. For a material change, we will give you reasonable advance notice (for example, by email or an in-app notice) before it takes effect, and we will update the “Last updated” date. Changes apply only going forward. If you do not agree to a change, you may stop using Theater and delete your account before the change takes effect, and for material changes we may require you to affirmatively accept the updated terms to keep using the service.
